1. delays and once again the Court apologizes, this morning

2. there was a matter in another court room that the Court

3. felt compelled to attend, also there were matters that had to be

4. taken care of here in this court room concerning this case

5. outside the presence of the jury and those matters have been

6. taken care of now and the Court appreciates your patience.
The State may proceed.

7. MISS WYLER: The State of Ohio calls Ron Postlethwait. He is in the

8. prosecutor's office, he should be on his way over, if you will

9. wait for him.

10. RON POSTELETHWAIT, called as a witness, first

11. being duly sworn, testifies as follows:

12. MISS WYLER: Your Honor did you want to inquire about any photographs?

13. THE COURT: Yes.
MISS WYLER: Thank You.

14. THE COURT: Sir, the Court will

15. ask whether you have any objections to being either

16. photographed or your voice recorded.

17. A. I don't mind.

18. THE COURT: All right.

19. MR. MARTINEZ: I didn't hear your answer.
A. I don't mind.

20. MR. MARTINEZ: You don't mind, all right.

21. THE COURT: You may proceed.

22. DIRECT BY MISS WYLER:

23. MISS WYLER: All right. Sir, will you state your name please?

24. A. Ronnie Wade Postlethwait.

25. Q. And will you spell that last name for the court reporter?
